Please read these Terms of Service ("Terms") carefully before using Fluctra (the "Service"), operated by Fluctra ("we", "us", or "our"). By accessing or using the Service you agree to be bound by these Terms.
Fluctra is a free-to-play online puzzle game available at fluctra.com and as an iOS application. You may use the Service for your personal, non-commercial entertainment. You agree not to:
You may play Fluctra without creating an account. If you choose to create an account, you are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account. You agree to provide accurate information when registering and to keep it up to date.
We reserve the right to suspend or terminate accounts that violate these Terms, post offensive usernames, or engage in behaviour that degrades the experience for other players.
By submitting a score to the global leaderboard, you agree that your chosen username and score may be displayed publicly to all players worldwide. Do not use a username that is offensive, defamatory, or that impersonates another person.
We reserve the right to remove or modify usernames and leaderboard entries at our sole discretion without notice.
Fluctra includes a virtual currency called Gems that can be earned through gameplay or purchased as optional gem packs ("Gem Packs"). Gems have no monetary value and cannot be transferred, redeemed for cash, or refunded once spent on in-game items.
Payments for Gem Packs are processed by Stripe (web) or Apple (iOS). All purchases are final and non-refundable except where required by applicable law. If you believe a charge was made in error, contact us at hello@fluctra.com.
We reserve the right to modify, discontinue, or rebalance the in-game economy at any time. We will not compensate players for changes to gem costs, power-up availability, or future features.
All content in the Service - including but not limited to the game design, code, graphics, symbols, sounds, and the FLUCTRA name and logo - is owned by or licensed to us and is protected by applicable intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from any part of the Service without our prior written permission.
The Service currently does not support public user-generated content. Your leaderboard username is the only user-created text we display publicly. By submitting a username you grant us a non-exclusive, worldwide, royalty-free licence to display it within the Service.
The Service integrates third-party services including Supabase (database and authentication), Stripe (payment processing), Google (Sign-In and advertising), and PayPal (payment processing). Your use of those services is governed by their respective terms and privacy policies. We are not responsible for the practices of any third-party service.
The web version of Fluctra may display advertisements served by Google AdSense. Ads help us keep the game free for everyone. We do not control the content of advertisements. If you encounter an ad that seems inappropriate, you may report it directly to Google via the "AdChoices" link on the ad.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
TO THE FULLEST EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT WILL OUR TOTAL LIABILITY TO YOU EXCEED THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM.
You agree to indemnify and hold us harmless from any claim, demand, loss, liability, and expense (including reasonable legal fees) arising out of your use of the Service, your violation of these Terms, or your violation of any third party's rights.
We reserve the right to modify, suspend, or discontinue any part of the Service at any time without notice or liability. We may add, remove, or change features, game modes, or gem pricing at our discretion.
We may update these Terms from time to time. The "Last updated" date at the top of this page reflects the most recent version. Your continued use of the Service after changes are posted constitutes your acceptance of the updated Terms.
These Terms are governed by and construed in accordance with the laws of the Province of Ontario, Canada, without regard to its conflict of law principles. You agree to submit to the exclusive jurisdiction of the courts located in Ontario for resolution of any dispute arising from these Terms.
